The T visa is a humanitarian visa designed to assist victims of human trafficking who have endured severe exploitation and abuse. It allows victims to remain in the United States to assist law enforcement in the investigation or prosecution of human trafficking cases while providing them with access to vital benefits and a path to permanent residency.
To qualify for a T visa, applicants must meet the following criteria:
- Victim of Severe Human Trafficking: The applicant must have been subjected to force, fraud, or coercion for the purpose of labor or commercial sex acts. Minors under 18 years old do not need to demonstrate force, fraud, or coercion if trafficked for commercial sex.
- Presence in the U.S.: The applicant must be physically present in the United States, its territories, or at a port of entry as a result of trafficking.
- Assistance to Law Enforcement: The applicant must comply with reasonable requests from law enforcement in the investigation or prosecution of trafficking crimes, unless they are under 18 or unable to cooperate due to trauma.
- Extreme Hardship: The applicant must show that removal from the U.S. would result in extreme hardship involving severe harm or danger.
T visa holders can remain in the U.S. for up to 4 years, with the possibility of extensions. They may apply for work authorization and access federal and state benefits, including healthcare and housing assistance. After maintaining T visa status for 3 years, or upon completing the investigation or prosecution, applicants may be eligible to adjust their status to become lawful permanent residents.
