NAFTA Professional (TN)
The TN (Trade NAFTA) visa is a nonimmigrant visa that allows qualified Canadian and Mexican citizens to work in the United States in certain professional occupations. Created under the North American Free Trade Agreement (NAFTA) and preserved under its successor, the United States-Mexico-Canada Agreement (USMCA), the TN visa fosters economic collaboration between the three countries by enabling the temporary employment of skilled professionals.
To qualify for a TN visa, the applicant must:
- Be a citizen of Canada or Mexico.
- Have a job offer from a U.S. employer in a profession listed in the USMCA (e.g., accountants, engineers, scientists, educators, and healthcare professionals).
- Possess the required qualifications, such as a degree or professional license, for the occupation.
- Intend to work in the U.S. temporarily and return to their home country upon the completion of their employment.
The application process differs slightly for Canadians and Mexicans:
- Canadian citizens can apply for TN status directly at a U.S. port of entry or pre-flight inspection location by presenting the required documentation, including proof of citizenship, a detailed employment offer letter, and evidence of qualifications.
- Mexican citizens must first obtain a TN visa at a U.S. consulate before entering the U.S. and then present the necessary documents at a port of entry.
The TN visa is initially granted for up to three years and can be renewed indefinitely in three-year increments. Spouses and dependent children of TN visa holders are eligible for TD status, although they cannot work in the U.S.
