The EB-5 Immigrant Investor Program offers foreign nationals the opportunity to obtain a U.S. green card by making a qualifying investment in the United States. Notably, after the program was modified in 2022, investors present in the U.S. may now directly file for adjustment of status concurrently with their I-526 or I-526E immigrant investor petition.

- Investment Amount: Invest a minimum of $1,050,000 in a new commercial enterprise. If the investment is in a Targeted Employment Area (TEA)—a rural area or an area with high unemployment—the minimum investment is reduced to $800,000.
- Job Creation: Demonstrate that the investment will create or preserve at least 10 full-time jobs for U.S. workers. For regional center projects, indirect and induced jobs can also count toward this requirement.
- At-Risk Investment: The invested funds must be at risk and intended for commercial activity. Passive or guaranteed investments do not qualify under the EB-5 program.
Applicants can invest directly in their own business venture or through a USCIS-designated Regional Center, which manages EB-5 projects and simplifies the process by pooling investments for large-scale developments. The EB-5 visa provides a pathway to permanent residency for the investor, their spouse, and unmarried children under 21.
